He resigned or was booted from the Labour party wasn't he? He was officially down as an independent.
He's a ** though and no different to a certain MP who retained his councillor status in West Yorkshire after he became MP for Blackpool South whilst still claiming the expenses etc.

Blackpool’s former council leader says he can still represent residents in the town despite moving nearly 300 miles away to Devon.

He was taking free tickets/ hospitality from the Pleasure Beach and was suspended from the Labour Party whilst they investigated. He then simply didn't renew his membership which meant they couldn't continue the investigation.
Nothing he did constituted criminal proceedings apparently. As Lytham says.. he is a bellend with little moral compass.
