Advice Please - PT Working

Good afternoon Tangerine Friends,

I am currently in the process of moving from the sunny south back to the magnificent north. Unfortunately, there is a sticking point with my contract, and I was hoping someone might be able to offer some advice regarding annual leave on a PT contract.

I have researched and researched and I even phoned ACAS last Friday and everywhere I look states that at PT contract includes Bank Holidays (BHs) in annual leave entitlement. The reason for this being that if say you work Tues-Thurs you miss out on maybe five days paid leave because BHs are mostly on Mondays. They are offering a pro-rata on leave plus BHs. I have declined several contracts now because they are unable to grasp this concept. I will add that my employer is not UK.

I'm struggling to know which way to turn next, so any advice would be gratefully received.

That's just tough. Bank Holidays are over and above your annual leave and therefore you'll only benefit if it's your working day.

All I can say is that when I was working full time 5 days and then dropped to 4 days (Mon-Thur) my holiday entitlement dropped pro-rata but I also had to use a couple of days holiday for Bank Hols as they also dropped Pro-Rata and dibbed out completely on Good Friday!

Now whether this was standard or not I don’t know, but I was so keen to get to a 4 day week I didn’t particularly care! Best move I made at the time as 4 on 3 off is a nice pattern. Plus, booking a weeks Holiday only “cost” me 4 days Annual Leave rather than 5 so remember to take that into consideration.

Good luck with the new job if you take it, but I’ll add that the best thing I did was to jack in completely and have an early retirement, but I guess it depends what stage you are in life 👍
 
It's a minimum 28 days PA based on 5 days ie 4 weeks + stats

If 4 days pw your annual entitlement is 22.4 - rounded up to 23 under the regulations against which you deduct those bank holidays which are work days

Interesting reply Wizaard, but this is the whole problem, and 'tough' is not the answer.
If you work FT you receive full pay for eight BHs a year, and in fact this year you receive 10 due to the additional two for the Queen's Platinum Jubilee. When you work PT it depends what days of the week you work and when BHs land.
I am suggesting the BHs and annual leave are pro-rata, but my non-UK boss is failing to understand this. My understanding is correct according to UK Employment Law.
What happens if this now results in a stand-off?

Thank you TAM. That is exactly what I have been advised by ACAS, but they (the employer) are not understanding this. I think they think that 23 is too many (more than currently FT), but I have explained that Christmas day, etc. will be deducted from this! Going around in circles.
 
These days with so much flexible working it's best to ignore the stats and just say 28 days
Far easier to work out
