O/T Any Contractors on here? (IR35)

What's your client saying post-April? Going for a risk-averse blanket inside determination across the board?

Mine has yet to decide...

😟

Yep. Mine is still to decide but my contract ends 28/2 and is not being extended so I am leaving without a determination (phew). Going to take a break and see if things settle down.
Very short sighted approach by HMRC/Government

Anyone who stays with the same client in a contract that has been determined as inside IR35 going forward, shouldn't have to wait too long for an HMRC investigation into their prior contracts with the same client.

Same here. All ours have been told we're within IR35 and no argument. Our company have said it's not even worth arguing or for them to take a risk.

HMRC have sworn they won't open investigations retrospectively. They have even pinky promised!

Do we believe 'em? Errr NO 🤥

Looks like HMRC have issued a change today.

The rules, also known as IR35, will now apply only to payments made for services provided on or after 6 April 2020. Previously, the rules would have applied to any payments made on or after 6 April 2020, regardless of when the services were carried out. It means organisations will only need to determine whether the rules apply for contracts they plan to continue beyond 6 April 2020, supporting businesses as they prepare.

I know a few people who planned to finish contracts a month early so there was no chance of receiving a payment after 6th April. Now it no longer matters - any work done before the 6th April is outside regardless of when the client pays you.

I think most people, myself included, have already made the call to walk. This may help a few you have not yet decided or not yet had their determination. Bit of a mess all this TBH
