O/T Land / fence advice

I’m hoping someone will be able to offer me some advice on a fence matter with my new neighbour and hopefully confirm my assumptions are correct…

I live on a hill and at one side of the rear of my garden is at the side fence is the back of another houses garden.

The houses/ gardens are tiered and there’s three levels. My home and garden are on one (Which I assume is owned by me without checking with land registry), his garden on another and his house on the third.

He’s told me that he’s intending on adding a new 6-foot fence to be added to on the level my property sits as my garden over looks his. This would normally be fine however as I’m on a corner plot I have great views to the side of his house from my garden. This was a major contributing reason for me buying the property and if the fence gets added it will mean that I lose the view.

I hope I’m stating the obvious and making the right assumption that the height of any fence that is on my level would be of my choice. If he was to build a fence himself the maximum height would need to be from his garden level?

If the fence is on the boundary line or his property, then he can put up any height he wants. He can't put up a fence on your property.
 
Don't mistake boundary with fence, he is perfectly entitled to put a fence of his choosing on his land. As for the height 6' is usually the permitted height but it may differ depending on which council you are in.
 
If it's your land then he can't do it, if it's his land he can, simple as that.

We put a six foot fence down our drive, just off the blocked paving to the side, next door's renters kicked up a fuss, tough shit knobheads it's our land, just because the driveway ends somewhere else.

I know someone who has great view across a field and the neighbour is building a two story house in place of a bungalow which will block their view. As long as it doesn’t encroach on their land the neighbour is allowed to do it.

The height is measured from the lowest point, which is your side. Technically he'll need planning permission, trouble is the planners won't prioritise this if he cracks on.

That's not correct on boundary fences. You can build up to 6ft but this is measured on the low side if the land slopes

No my house / garden is on the highest tier. I can look down onto his garden. The way the fence is current I assume it has been judged from his side before.
 
If the higher plot is yours (highly likely) then he can't stick a fence on it. 6 ft tall without planning for his lower side especially if that it is where it is now.
