...over the penthouse.

Firstly, BFC are going down the route of applying to have the penthouse made the subject of an Energy Performance Certificate, if they succeed they can get access.
OO, of course, is trying to cling on by his fingernails by counter claiming, saying the commercial certificate covering the stand & hotel suffices.

BUT it looks like this is just the appetiser for the main course - BFC are looking to secure possession of the penthouse through a Section 21 eviction.
"It is expected Mr Oyston will contest those proceedings" - has he learnt nothing from his long run of legal losses?

 
The bloke is a complete parasite and an absolute embarrassment.

Before leaving it would seem he adopted a ‘scorched earth’ policy, which along with this Penthouse scam, further reinforces the narcissistic and spitefully petty nature of the man.

Hopefully common sense will ultimately prevail and ‘once again’ the courts will see through him.

Was not the lease in his daughters name
At the time he owned it and I thought he leased the penthouse and some office space to her to make sale process more protracted, and he has been successful in that

Having just spent 5 years trying to get a tenant out of a house on a Section 21......So don't hold your breath for Owen going quietly.
Technically, his EPC can be done without a visit

Personally, I would be calling the fire brigade after seeing smoke coming out of the windows, next Wednesday around 6,30pm.
And that's when they find the prescription drugs, kiddy porn and Sam chained up in the Gimp cellar.....BOOM, he's out

I seem to remember that morticia and her boyfriend were in control at the time and the day before the administrators moved in, they granted themselves a lease, then held a champagne party in the hotel to celebrate.
 
If BFC don't have a current EPC, a Section 21 notice is invalid. If Oyston won't allow access for an EPC survey, the club will firstly have to issue a Section 8 as he has probably broken the terms of the rental agreement. So it can be a very long winded process if the tenant is determined to stay.
I've recently had some good advice on this from a fellow BFC fan.
I can't for the life of me see why he'd want to stay? I can only assume he's still bitter about the way he lost the club and is being as awkward as possible right to the end.
 
From his pov, it's his way of keeping BFC close to him. To look out at the pitch (I'm sure you can do that) and watch the games from the window.

It's possibly all he has left.

He clearly doesn't need the penthouse but wants to stick two fingers up to Simon Sadler and show that he's still in a position to influence some things at Bloomfield Road. It's not easy to evict anyone from residential property under laws designed to protect the vulnerable. Obviously OO is anything but vulnerable. At present, his family is legally entitled to be there and Oyston knows that only too well.

Wonder which legal eagles the club are using, its been going on a few years now so has been profitable for them. How much longer can the shysters draw it out. Money for old rope.
 
It would depend on the terms of the lease, but if possible I'd be putting a 20ft advertising board in front of that area so no matchday access from the window. Also there is access to the roof which I'm sure could be hindered someway.

But in reality BFC will have been through all that they can do legally and are where they are now.

As @seasideone says it will be his death that comes first. Question is can he leave the lease in his will?

When I came back to live on the Gold Coast in 2015, I was dismayed at the situation. I was obviously looking forward to buying a season ticket, but the protests had begun and I just couldn’t do it. I wrote to OO to say I could help resolve the issues, and blow me down, I was invited to meet him in the penthouse. I told him he needed to get rid of Karl for starters, but he wasn’t in listening mode and proceeded to spend three quarters of an hour telling me how wonderful he was. This was two days before the infamous fans meeting at the Hilton and it was clear he used my meeting to rehearse his speech. The view is fantastic, the experience was weird.
 
I would imagine that the lease is for a long period of 75,100, or even 125 years similar to those you get on the expensive apartments in London,
if so they can be passed down in a will. Think it will cost Sadler/the club money to get them out, and clearly this isn't going to happen
until Owen dies.

I thought at the time. The lease was resigned for 5 years so I thought they’d have to be out feb 2024/2025 depending what year it was resigned. I thought 2019
Maybe somebody from the tangerine knights or BST could look back and maybe find something to clarify what I’m thinking

Surely though the fact that it’s not his main residence must count for something. I wonder how many days it’s actually occupied in a year
